Diese AGB regeln die Nutzung der mobilen App PureStats für Android sowie der Website purestats.app, betrieben von Define Studios (Enrico Götze), Grüenaustrasse 14a, 9630 Wattwil, Schweiz. Mit der Nutzung der App akzeptierst du diese Bedingungen.
⚠ WICHTIGER HINWEIS
PureStats stellt keine Wettempfehlungen dar. Die App ist ein reines Analyse- und Informations-Tool und liefert statistische Wahrscheinlichkeiten, keine Gewinnversprechen. Wetten erfolgen auf eigenes Risiko bei lizenzierten Drittanbietern.

1. GELTUNGSBEREICH
Diese AGB gelten für alle Nutzer der PureStats-App und der Website purestats.app, sowohl in der kostenlosen als auch in der Premium-Version. Abweichende Bedingungen werden nicht anerkannt, sofern nicht ausdrücklich schriftlich vereinbart.
2. LEISTUNGSBESCHREIBUNG
PureStats bietet:
- Statistische Analysen von Fußballspielen (ELO, xG, Form, H2H, Aufstellungen)
- Berechnete Wahrscheinlichkeiten und faire Quoten für verschiedene Wettmärkte (1X2, Über/Unter, Asian Handicap, Team-Tore etc.)
- Eine Einordnung der berechneten Werte nach Datenqualität und Verlässlichkeit (das Modell dient als „Zweitmeinung")
- Einen CLV-Tracker, mit dem du deine eigenen Wetten erfassen und deren Einkaufsqualität (Closing Line Value) auswerten kannst
- Einen Wettrechner zur Bewertung einzelner und kombinierter Wetten
- Historische Performance-Daten der eigenen Analysen (Transparenz-Funktion)
Die Analysen basieren auf öffentlich verfügbaren Spieldaten und mathematischen Modellen. PureStats liefert Wahrscheinlichkeiten und Statistik; ein finanzieller Gewinn wird weder versprochen noch in Aussicht gestellt. Es wird keine Garantie für die Richtigkeit der Prognosen übernommen.
3. GLÜCKSSPIEL-HINWEIS
Wetten ist eine Form des Glücksspiels und kann zu finanziellen Verlusten führen.
- Nutzung der App erst ab 18 Jahren erlaubt
- Setze niemals Geld, das du nicht verlieren kannst
- Vergangene Performance ist keine Garantie für zukünftige Ergebnisse
- Du bist selbst dafür verantwortlich, dass Sportwetten an deinem Wohnsitz bzw. Aufenthaltsort rechtlich zulässig sind, und platzierst sie ausschliesslich bei dort lizenzierten Anbietern
- Bei Anzeichen von Spielsucht: Hilfe annehmen (siehe Hinweis oben)
4. PREMIUM-ABONNEMENT
4.1 Zwei Kaufwege
Premium kann auf zwei Wegen erworben werden. In der Android-App über Google Play Billing; Vertragspartner der Zahlung ist dort Google. Oder direkt auf purestats.app über unseren Zahlungsdienstleister; Vertragspartner ist dann der unter Impressum genannte Anbieter. Wo sich die Regeln unterscheiden, ist das nachfolgend jeweils angegeben.
4.2 Preis und Laufzeit
Die geltenden Preise und Laufzeiten werden vor Kaufabschluss angezeigt, in der App beziehungsweise im Bestellvorgang auf der Website. Angegebene Preise verstehen sich einschliesslich der gesetzlichen Mehrwertsteuer des Landes, in dem du deinen Wohnsitz hast.
4.3 Automatische Verlängerung
Abonnements verlängern sich automatisch um den gewählten Zeitraum, sofern nicht spätestens 24 Stunden vor Ablauf gekündigt wird.
4.4 Kündigung
Bei Kauf über Google Play: Play Store → Profil → Zahlungen & Abonnements → Abos → PureStats → Kündigen. Ein über Google abgeschlossenes Abonnement kann der Anbieter nicht selbst kündigen.
Bei Kauf über die Website: jederzeit im eigenen Konto, ohne Angabe von Gründen. Eine formlose E-Mail an die im Impressum genannte Adresse genügt ebenfalls. Die Kündigung wird zum Ende der laufenden Abrechnungsperiode wirksam; bis dahin bleibt der Zugang bestehen.
4.5 Testphase
Neue Nutzer erhalten ab dem 24.09.2026 sieben Tage kostenlosen Zugang. Nutzer, die sich vor diesem Datum erstmals angemeldet haben, behalten die ihnen ursprünglich zugesagten dreissig Tage; für sie ändert sich nichts. Ein kostenpflichtiges Abonnement beginnt nach Ablauf der Testphase nur dann, wenn du zuvor eine Zahlungsart hinterlegt und der Fortsetzung zugestimmt hast.
5. WIDERRUFSRECHT
Verbrauchern in der EU steht bei Fernabsatzverträgen grundsätzlich ein Widerrufsrecht von vierzehn Tagen zu.
Bei Kauf über Google Play richten sich Widerruf und Erstattung nach den Google-Play-Erstattungsrichtlinien; Vertragspartner der Zahlung ist Google.
Bei Kauf über die Website kannst du binnen vierzehn Tagen ohne Angabe von Gründen widerrufen. Eine formlose Erklärung per E-Mail an die im Impressum genannte Adresse genügt. Bereits gezahlte Beträge erstatten wir unverzüglich, spätestens binnen vierzehn Tagen nach Zugang des Widerrufs, über dasselbe Zahlungsmittel.
Sofortiger Zugang und Erlöschen des Widerrufsrechts: Digitale Inhalte werden unmittelbar nach Kaufabschluss bereitgestellt. Im Bestellvorgang wirst du ausdrücklich gefragt, ob wir sofort damit beginnen sollen. Stimmst du zu, erlischt dein Widerrufsrecht mit der vollständigen Bereitstellung (Art. 16 lit. m der Richtlinie 2011/83/EU). Stimmst du nicht zu, beginnt der Zugang nach Ablauf der Widerrufsfrist.
6. HAFTUNGSAUSSCHLUSS
Der Anbieter haftet nicht für:
- Finanzielle Verluste durch Wetten basierend auf App-Analysen
- Datenfehler durch externe Anbieter (API-Football, Buchmacher)
- Server-Ausfälle oder Wartungsfenster
- Folgeschäden jeglicher Art
Die Haftung ist auf grobe Fahrlässigkeit und Vorsatz beschränkt.
7. DATENSCHUTZ
Die Verarbeitung personenbezogener Daten ist in der Datenschutzerklärung geregelt (siehe separater Menüpunkt).
8. KONTO- UND DATENLÖSCHUNG
Du kannst die in der App gespeicherten Daten jederzeit direkt in der App löschen. Das schliesst die von dir im CLV-Tracker erfassten Wetten ein. Eine vollständige Löschung deines Kontos ist zusätzlich über den Menüpunkt „Konto löschen" oder per E-Mail an egoetze@purestats.app möglich.
9. ÄNDERUNGEN DER AGB
Wir behalten uns vor, diese AGB anzupassen. Bei wesentlichen Änderungen wirst du in der App informiert. Eine Weiternutzung nach Mitteilung gilt als Zustimmung.
10. SCHLUSSBESTIMMUNGEN
10.1 Anwendbares Recht
Es gilt Schweizer Recht. Bei Verbrauchern aus der EU/EWR bleiben die zwingenden Verbraucherschutzbestimmungen ihres Heimatlandes unberührt.
10.2 Gerichtsstand
Ausschliesslicher Gerichtsstand ist Wattwil, Schweiz, soweit gesetzlich zulässig.
10.3 Salvatorische Klausel
Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen unberührt.

PureStats does not constitute betting recommendations. The app is a pure analysis and information tool and provides statistical probabilities, not promises of winnings. Bets are placed at your own risk with licensed third-party providers.

1. SCOPE
These Terms apply to all users of the PureStats app and of the website purestats.app, both in the free and the Premium version. Deviating terms are not recognized unless expressly agreed in writing.
2. DESCRIPTION OF SERVICES
PureStats offers:
- Statistical analyses of football matches (ELO, xG, form, H2H, line-ups)
- Calculated probabilities and fair odds for various betting markets (1X2, Over/Under, Asian Handicap, team goals, etc.)
- A classification of the calculated values by data quality and reliability (the model serves as a "second opinion")
- A CLV tracker with which you can record your own bets and evaluate their purchase quality (Closing Line Value)
- A bet calculator for evaluating single and combined bets
- Historical performance data of your own analyses (transparency function)
The analyses are based on publicly available match data and mathematical models. PureStats provides probabilities and statistics; a financial gain is neither promised nor held out in prospect. No guarantee is assumed for the accuracy of the forecasts.
3. GAMBLING NOTICE
Betting is a form of gambling and can lead to financial losses.
- Use of the app is only permitted from the age of 18
- Never stake money that you cannot afford to lose
- Past performance is no guarantee of future results
- You are yourself responsible for ensuring that sports betting is legally permissible at your place of residence or place of stay, and you place bets exclusively with providers licensed there
- At signs of gambling addiction: accept help (see notice above)
4. PREMIUM SUBSCRIPTION
4.1 Two purchase paths
Premium can be purchased in two ways. In the Android app via Google Play Billing; the contracting party for the payment is Google. Or directly on purestats.app via our payment service provider; the contracting party is then the provider named in the imprint. Where the rules differ, this is stated below.
4.2 Price and term
Applicable prices and terms are shown before the purchase is completed, in the app or during checkout on the website. Prices shown include the statutory VAT of the country in which you reside.
4.3 Automatic renewal
Subscriptions renew automatically for the selected period unless cancelled at least 24 hours before expiry.
4.4 Cancellation
For purchases via Google Play: Play Store, Profile, Payments & subscriptions, Subscriptions, PureStats, Cancel. A subscription concluded through Google cannot be cancelled by the provider.
For purchases via the website: at any time in your own account, without giving reasons. An informal e-mail to the address stated in the imprint is equally sufficient. The cancellation takes effect at the end of the current billing period; access remains until then.
4.5 Trial phase
New users receive seven days of free access from 24 September 2026. Users who first registered before that date keep the thirty days originally granted to them; nothing changes for them. A paid subscription only begins after the trial phase if you have previously provided a payment method and agreed to the continuation.
5. RIGHT OF WITHDRAWAL
Consumers in the EU generally have a fourteen-day right of withdrawal for distance contracts.
For purchases via Google Play, withdrawal and refunds are governed by the Google Play refund policies; the contracting party for the payment is Google.
For purchases via the website you may withdraw within fourteen days without giving reasons. An informal declaration by e-mail to the address stated in the imprint is sufficient. We refund amounts already paid without undue delay, at the latest within fourteen days of receiving the withdrawal, using the same means of payment.
Immediate access and expiry of the right of withdrawal: digital content is made available immediately after the purchase is completed. During checkout you are expressly asked whether we should begin immediately. If you agree, your right of withdrawal expires upon complete provision (Art. 16(m) of Directive 2011/83/EU). If you do not agree, access begins after the withdrawal period has elapsed.
6. DISCLAIMER
The provider is not liable for:
- Financial losses from bets based on app analyses
- Data errors by external providers (API-Football, bookmakers)
- Server outages or maintenance windows
- Consequential damages of any kind
Liability is limited to gross negligence and intent.
7. DATA PROTECTION
The processing of personal data is governed by the privacy policy (see separate menu item).
8. ACCOUNT AND DATA DELETION
You can delete the data stored in the app at any time, directly in the app. This includes the bets you have recorded in the CLV tracker. A complete deletion of your account is additionally possible via the "Delete account" menu item or by email to egoetze@purestats.app.
9. CHANGES TO THESE TERMS
We reserve the right to amend these Terms. In the event of significant changes, you will be informed in the app. Continued use after notification is deemed acceptance.
10. FINAL PROVISIONS
10.1 Applicable law
Swiss law applies. For consumers from the EU/EEA, the mandatory consumer protection provisions of their home country remain unaffected.
10.2 Place of jurisdiction
The exclusive place of jurisdiction is Wattwil, Switzerland, insofar as legally permissible.
10.3 Severability
Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.

1. ÁMBITO DE APLICACIÓN
Las presentes Condiciones Generales se aplican a todos los usuarios de la aplicación PureStats y del sitio web purestats.app, tanto en la versión gratuita como en la versión Premium. No se reconocerán condiciones divergentes, salvo que se acuerden expresamente por escrito.
2. DESCRIPCIÓN DE LOS SERVICIOS
PureStats ofrece:
- Análisis estadísticos de partidos de fútbol (ELO, xG, forma, H2H, alineaciones)
- Probabilidades calculadas y cuotas justas para diversos mercados de apuestas (1X2, Más/Menos, hándicap asiático, goles de equipo, etc.)
- Una clasificación de los valores calculados según la calidad y fiabilidad de los datos (el modelo sirve como «segunda opinión»)
- Un rastreador de CLV con el que puedes registrar tus propias apuestas y evaluar su calidad de contratación (Closing Line Value)
- Una calculadora de apuestas para valorar apuestas individuales y combinadas
- Datos históricos de rendimiento de los propios análisis (función de transparencia)
Los análisis se basan en datos de partidos disponibles públicamente y en modelos matemáticos. PureStats proporciona probabilidades y estadísticas; no se promete ni se ofrece la perspectiva de una ganancia financiera. No se asume ninguna garantía sobre la exactitud de los pronósticos.
3. AVISO SOBRE JUEGO
Apostar es una forma de juego de azar y puede conllevar pérdidas financieras.
- El uso de la aplicación solo está permitido a partir de los 18 años
- Nunca apuestes dinero que no puedas permitirte perder
- El rendimiento pasado no garantiza resultados futuros
- Eres el único responsable de que las apuestas deportivas sean legalmente admisibles en tu domicilio o lugar de residencia, y las realizas exclusivamente con proveedores allí licenciados
- Ante indicios de ludopatía: acepta ayuda (véase el aviso anterior)
4. SUSCRIPCIÓN PREMIUM
4.1 Dos vías de compra
Premium puede adquirirse de dos maneras. En la aplicación Android a través de Google Play Billing; la parte contratante del pago es Google. O directamente en purestats.app a través de nuestro proveedor de servicios de pago; la parte contratante es entonces el proveedor indicado en el aviso legal. Cuando las reglas difieren, se indica a continuación.
4.2 Precio y duración
Los precios y duraciones vigentes se muestran antes de finalizar la compra, en la aplicación o durante el proceso de compra en el sitio web. Los precios indicados incluyen el IVA legal del país en el que resides.
4.3 Renovación automática
Las suscripciones se renuevan automáticamente por el periodo seleccionado, salvo que se cancelen como muy tarde 24 horas antes de su vencimiento.
4.4 Cancelación
En compras a través de Google Play: Play Store, Perfil, Pagos y suscripciones, Suscripciones, PureStats, Cancelar. El proveedor no puede cancelar una suscripción contratada a través de Google.
En compras a través del sitio web: en cualquier momento desde tu propia cuenta, sin necesidad de indicar motivos. También basta con un correo electrónico informal a la dirección indicada en el aviso legal. La cancelación surte efecto al final del periodo de facturación en curso; hasta entonces se mantiene el acceso.
4.5 Fase de prueba
Los nuevos usuarios reciben siete días de acceso gratuito a partir del 24 de septiembre de 2026. Los usuarios que se registraron por primera vez antes de esa fecha conservan los treinta días que se les concedieron originalmente; para ellos no cambia nada. Una suscripción de pago solo comienza tras la fase de prueba si previamente has facilitado un medio de pago y has aceptado la continuación.
5. DERECHO DE DESISTIMIENTO
Los consumidores de la UE disponen, en principio, de un derecho de desistimiento de catorce días en los contratos a distancia.
En compras a través de Google Play, el desistimiento y el reembolso se rigen por las políticas de reembolso de Google Play; la parte contratante del pago es Google.
En compras a través del sitio web puedes desistir en un plazo de catorce días sin indicar motivos. Basta con una declaración informal por correo electrónico a la dirección indicada en el aviso legal. Reembolsaremos los importes ya abonados sin demora indebida, a más tardar en el plazo de catorce días desde la recepción del desistimiento, utilizando el mismo medio de pago.
Acceso inmediato y extinción del derecho de desistimiento: los contenidos digitales se ponen a disposición inmediatamente después de finalizar la compra. Durante el proceso de compra se te pregunta expresamente si debemos comenzar de inmediato. Si aceptas, tu derecho de desistimiento se extingue con la puesta a disposición completa (art. 16 m de la Directiva 2011/83/UE). Si no aceptas, el acceso comienza una vez transcurrido el plazo de desistimiento.
6. EXENCIÓN DE RESPONSABILIDAD
El proveedor no se hace responsable de:
- Pérdidas financieras derivadas de apuestas basadas en los análisis de la aplicación
- Errores de datos causados por proveedores externos (API-Football, casas de apuestas)
- Caídas del servidor o ventanas de mantenimiento
- Daños indirectos de cualquier tipo
La responsabilidad se limita a la negligencia grave y al dolo.
7. PROTECCIÓN DE DATOS
El tratamiento de datos personales se regula en la Política de Privacidad (véase el apartado de menú independiente).
8. ELIMINACIÓN DE CUENTA Y DATOS
Puedes eliminar en cualquier momento los datos almacenados en la aplicación, directamente en la aplicación. Esto incluye las apuestas que hayas registrado en el rastreador de CLV. Además, es posible eliminar por completo tu cuenta a través del apartado de menú «Eliminar cuenta» o por correo electrónico a egoetze@purestats.app.
9. CAMBIOS EN LAS CONDICIONES
Nos reservamos el derecho de modificar las presentes Condiciones Generales. En caso de cambios sustanciales, se te informará en la aplicación. El uso continuado tras la notificación se considerará como aceptación.
10. DISPOSICIONES FINALES
10.1 Derecho aplicable
Se aplica el derecho suizo. En el caso de consumidores de la UE/EEE, permanecen inalteradas las disposiciones imperativas de protección al consumidor de su país de origen.
10.2 Jurisdicción
El fuero exclusivo es Wattwil, Suiza, en la medida en que sea legalmente admisible.
10.3 Cláusula de divisibilidad
En caso de que alguna disposición de las presentes Condiciones Generales resulte ineficaz, la validez de las restantes permanecerá inalterada.
